Thats not a bad question. If their medical staff screwed up and potentially jeopardized a player and his career and thus his potential earnings I could see a case being made, I dont know what the League regulations on that are.

Unless there is explicit evidence of ignoring team doctor recommendations, it will be tough to find the team itself liable.

And the team doctors themselves won't be held liable unless there is clear evidence that they ignored dangerously vulnerable symptoms, and their clearance to play affected the outcome. Regardless of their decision to clear him at that time, or wait a little longer, this is a hockey player with significant neck injury who returned to play a professional contact sport, and is at high risk of reinjury regardless. In addition, he played a long time after clearance, suggesting that their clearance timing was not the most important factor. They may have cleared him too early, but it's a tough argument to make that they directly impacted his outcome with timing of clearance. Remember that the flames doctors also cleared him to play multiple times.

I didn't see that this has been discussed yet, but it reminded me of the Gary Roberts situation while he was in Calgary.
I know the "neck issues" are complicated and are likely not the same, but Smid's dedication to fitness reminds me of Roberts. I wonder if he's worked with him or contacted Gary?
It would be great if after a year Smid was able to replicate Gary's comeback
