A concussion is a brain injury. The effects of concussions (headaches, etc.) can take months to heal fully. Surely, you don't expect someone not to drive because they received a concussion, and its not fully healed.
Just because you received a concussion, say 4 weeks ago, doesn't mean you are incapacitated and incapable of driving a vehicle.

IMO you didnt cut her off, but if it was icey enough that she spun out when hitting the breaks, then you were a ###### by lange changing with only one or 2 feet between bumpers. If that comes out then you will likely be at fault. Alberta Govt has safe stopping distance charts, depending on your speed, 1-2 feet isnt alot.

Just IMO of course.

The brain injury thing is likely complete BS. I wouldnt talk to her again. Let them go through your attorney.

Why are you even talking to this woman? She seems like she's out for cash.

Don't admit any guilt, and tell her to stop contacting you and only do deal with your insurance company.

Call a lawyer. Get some professional advice. The brain injury claim puts a whole different spin on this than your std fender bender.

Actually, yes, I can. If someone is having dizzy spells and other post concussion symptoms, do we want them driving a car? I sure as hell don't.

Well Habby, those are two very different things.

Having had a concussion before I know that any time I got my bell rung in the year afterwards had a more serious effect than before.

So it's one thing to have had a concussion before, not showing symptoms, and then after a car crash having symptoms re-appear; than it is for your example which makes the assumption that past brain injury means their driving ability is currently impaired.

Agreed..... as someone who has driven themselves to the hospital with full on concussion symptoms.... I had to close one eye and hold onto my console to get rid of the dizziness.

All the doctor could do was recommend not driving... There is no temporary stop on driving for concussions, because the symptoms are so subjective.

For the OP ... stop talking about fault and contact your insurance company...

How? Stuff like this happens all the time. It's not like I hit her but this morning she said she had some sort of headache, but the lady had head problems in the past. So take it for what it's worth.

Gozer is right dude. It's probably too late to leave the country anyway since the authorities have your identity now. If it were me I'd kill a hobo, assume his identity and lay low for a period of not less than 3 years.

Have to echo what others have said. Don't be talking to this gal and let your insurance company handle this. Chances are she'll try to use anything you've said in an effort to make you at fault for the accident.
