This is the same thing as USING it. You are using ownership of said domain name not belonging to you for profit.
It's not the same thing, not even close. Buying a piece of property is fair game, as it should be.

As far as I can see the only person using the domain name for profit is the domain name seller at the begining of the process, I suppose they should be sued for selling some thing with a trademarked name on.
If you buy the name and don't use it you are not making a profit and if you sell it to the trade mark holder they, by dint of buying it, are giving you permission to use it.
