Just to pile on, from someone who's worked on some DUI files, one of the "rules" for maximizing your chance to avoid conviction is always, always blow. As mentioned there's a million things that can go wrong with breathalyzers, and especially with the process because they have to adhere strictly to Charter rules on collecting evidence. With refusal to blow there's much much less to go on as a defence lawyer.

They have had this law in Manitoba for years. I blew 0.07 once, and I was given a 48 hour driving suspension in 1998. Luckily, my friend was sober enough to take the wheel, and drive me home.

If they've had the same thing in Manitoba for years, then why was your friend allowed to drive your car home?

Why do they impound your vehicle for 3 days if you blow over .05? It's not like you need that long to sober up.
