The main point is that non-disclosure involving sex has been considered a crime. Now for non-disclosure to be a crime you would have to prove that the non-disclosure caused you harm. This is where she doesn't have a case.
So while I disagree with the man being charged I think that their would be a case to be made in some circumstance where lying to someone to get them to have sex with you could be considered a crime. What crime and what the punishment would be I am still not sure. But if cyber-bullying is becoming criminal meaning that words can cause criminal harm couldn't lying to get laid be construed as the same thing.

It's fairly simple. If a woman says to me "I am deeply religious and will only have sex with a fellow Scientologist so as not to condemn my soul to eternal damnation", and I reply with "you are in luck for I learned all I needed to know at the knee of L. Ron Hubbard", I think this deception is material and serious enough where I can see this being deemed "sexual assault".
Recall the fellow in Pennsylvania who was charged after getting sex by pretending to be Roethlisberger - what was he actually charged with (I cannot remember)?
Now, this case certainly doesn't seem to be that serious, and either we are lacking some material facts or we have a judge who takes race/religion very seriously....

Totally agree, the lady is a fine example of outstanding morality. Getting taken in a delivery van in an alley by a guy she just met screams of religious values.
She should be less worried about the religion of the guy she slept with and more worried about the STi's (right?) that she has from her other 999 conquests.

As far as my understanding goes, Rape is forcing intercourse upon someone without consent. There had to be a moment where the people involved said "You want to do this", where the other one said "Yes". Unless she said "You want to do this, Daniel?", I don't think she has a case.

The Israeli woman in this story gave her dignity away just like "Daniel" did, so what exactly did this guy steal? Clearly not her virginity.
As for this religious deception being material, I think that sets an ugly precedent that I'd rather not get into. Let's hope there are missing facts because otherwise someone's going to miss out on 18 months of freedom.

According to the news reports I can find the charges were due to money he obtained based on his impersonation, so it was a theft issue. I don't know of any instance where lying about identity (as opposed to having STD's) to obtain sex has ever been found to be a crime by a US or Canadian court. Hopefully not an Australian one either, as I was a locked out NHL player living in Sydney on certain evenings in 2005

I almost made it with a girl when I was about 17, out at Kenossee Lake in SE Saskatchewan. Turns out the whole night, she thought I was some dude named Zach. As it was getting heavy, I stupidly admitted my name was indeed, Algernon. She slapped me and got quite angry. I have regretted my stupidity for 14 years.

Yeah, evidently a name like 'Algernon' is a serious dealbreaker. Should have rolled with Zach, and then when the deed was done you could profess that your name was Zach, but you may or may not have been the Zach she was looking for. Mistaken identity is a legal defense!
