The thing with drinking and driving is that it's such a preventable thing. It's little things that can really prevent it. ALWAYS Pre-Plan. My family has 4 Oiler season tickets (Yes I'm an Oilers fan) and when my brother and I always take 2 buddies to a game, we all usually drink.

We always get dropped off by one of our wives and cab it back. Sometimes one of us will be the DD for the night.

When we go to a house party, we all put our keys in one spot and give them to a person not drinking. Even times that we haven't we just leave our cars there and cab it home. It's better to take a cab for x amount of dollars than pay $10 000- $20 000 for a lawyer who can't guarantee anything.

I have a friend. Pretty smart guy. has his own business. he's successfull. He drinks here and there, but not that much. Just at parties or hockey games. He drank a lot at a party and ended up sleeping at our friends house. He knew he was buzzing. He got up 6 hours later around 6am and drove home. Cop got behind him and could tell he wasn't driving straight.

Pulled him over, he blew over, and now he has a criminal record. It's going to be pardoned, but he still had to live with that for 3 or so years. Lucky for him he already had his business going and wasn't looking for a job.

Everytime these accidents come there is always a call for stiffer penaties. I don't think that is the solution. As someone who used to drink and drive a lot and was eventually caught before killing someone I have put a lot of thought into why I did it.

The biggest reason is that their is very little consequence to doing it and that the behaviour is self re-enforcing. You start out limiting yourself to 3 or 4 beers and being under .08 and then you have a few more and you don't have any problems. Then you stop worring all together about doing it as it becomes a "Safe" behaviour. Never once did I think about the penalties if I got caught. If you could catch everyone who drank in drove the first time they did it you would solve the problem.

The key lies in better enforcement not harsher penaties. If you could make people believe that they would be caught 10% of the time they did it the problem would disappear. Drinking and driving needs to be more dangerous to stop it.
