I think this guy is out to lunch, but to play devils advocate a bit here.
Like the infamous MacDonald's incident, there is a good reason to ensure that the food you are giving your customers is not hot enough to burn them. What if it was not a seizure and she had simply slipped and spilled the poutine over some unsuspecting kid munching on his popcorn chicken?
There are, and for good reason, standards about how hot food can be when served to customers. If this was violated, then regardless of the presence of the seizure, the company will probably be found liable to pay for any damages or medical costs.
Knowing the American legal system, he will walk away with a big chunk of cash in his pocket.

If food isn't hot enough, people get food poisoning. If food is too hot, people burn themselves. Lets face the facts, even with modern society, some people suck as staying alive.

Fortunately, this happened in Canada, so no large payout is likely.
And what you are suggesting re: the McDonalds coffee case does make sense - but there also plays a reasonable expectation here. It is reasonable to assume that a person might fumble their coffee and spill it on themselves (even if the dumb woman did it to herself by 'drinking and driving'). But it isn't reasonable to force a restaurant to worry about someone doing a face plant in their gravy cheese fries.

Agreed, well said.
I'm sorry the kid got burnt, but suing over "Poutine Face" is stupid. What's next, suing because of the cottage cheese butt you got from all that hot poutine?
I'm starting to think that Darwin fella might be onto something.....

Well, now that you mention it....
I suppose being prone to seizures would be fall under the category of 'natural selection'.
Whether natural selection is a good thing or not.....I don't know that I'm really scientifically qualified to make that determination, so I'll defer to someone else.
So, now that the sarcasm is done......relax. You're far too sensitive today.
