I didn't think I should start a new thread considering that I think my situation fits the bill. In any case, two years ago I rear ended someone. There was no damage that I could see but the police were called becuase the other party would not give up is name and insurance information. All in all, the police report said there was no injuries and no damage. I reported it to my insurance company anyways because I didn't trust the guy. Fast forward two years (at the date that the claim should be closing and the other party will not be able to get any more money) and I call for an update and I am told that they paid out 700 for a new bumper (fine, fair enough, I can accept that with no problem) but also that the guy is wanting to sue me for $60,000+ for damages. The agent I am dealing with at the insurance company said that they came forward wanting a larger sum because of the soft tissue cap being struck down (apparently they had not heard anything regarding a liability claim before this). Now, whether it is fraud or not is not really the point of my post. I have my own feelings on it, but obviously not much can be done about it now. What I want to know is, if they go to court and end up having to pay the guy all the money he wants, will my insurance rates go up higher than they already have? (It was my first and only accident, but the company I was with did not believe in the 'one free accident' for drivers under 25.) And also has anyone had experience with going to court for one of these cases? I'm just not sure what to expect...
