Thats probably because, when the officer asks "have you had anything to drink tonight"?, they say "no". Some seasoned alcohol consumers can quite easily get away with it. Admission to consumption=breathalyzer or automatic suspension.

It also has to do with the fact that some people, who don't drink very often, can have two or three beers and their eyes go glossy and their face turns red. Where as a seasoned vet can have four beers over the same period and they may be over the legal limit but you can't tell from their appearance.

Also your last statement should look more like this...

Admission to consumption ≈ Breathalyzer. Where if Breathalyzer ≥ 0.05 but < 0.08 than Breathalyzer = Automatic Suspension. If Breathalyzer ≥ 0.08 than you = Screwed - (Lawyer * $/hr)³.
