Its an interesting lawsuit.
Is a food establishment liable if a service is provided for free and then they dont provide it.
The two who rushed to the hospital are obvious ambulance chasers but the actual guy in it might be entitled to something. It would set a very bad precendent but...

Should I even ask where he got the peanuts

It would be a very bad precident to argue that a man who failed to properly consider his own health risks is entitled to anything.
This entire story feels like a setup for a lawsuit. It is a complete scam, and I hope McDonalds fights back.

What the hell? I can think of one independent step to make sure there is no cheese: lifting the bun... and then looking. Clearly he didn't do that. I'm curious to know what the 5 other possible independent steps are...

Exactly.
The same thing can simply be accomplished by biting into it to see if you have an allergic reaction.
The guy was just saving time/effort.
What do you guys want to bet this dude doesn't order Quarter Pounders "Without Cheese" every day in the hopes of getting one with Cheese so he can pull this off?

Actually, peanuts are not nuts...they are legumes. There are people who are allergic to peanuts but not to other nuts such as almonds and hazelnuts and vice-versa. Other people are allergic to nuts and peanuts. Technically, it is possible that a bag of peanuts could be made and packaged in a factory that does not handle nuts.

So much for personal accountability. If he's that damn allergic to cheese he should look iniside the burger for it. Usually if something causes me pain or discomfort, i look out for it the 2nd time around.

One time, they forgot to give me a straw, and when they finally handed it to me through the pickup window, it fell on the floor, and when I bent over to pick it up, I smacked my head on the dash. That's gotta be worth at least 75k you'd think.

Don't people sue for inflated amounts in an attempt to place a median close to what they really want? As in, this guy isn't really expecting $10 million but wants to set the bar as high as he can.
I'm just curious.

And of coarse tasting it, that's 5 steps right there.

This one sounds more real than the other one. Also more plausible to believe that he didn't know about the band-aid inside the cookie.
And it doesn't appear he's suing for an outrageous amount like the other lawsuit.

Carte also contends his lawsuit isn't like the infamous McDonald's hot coffee case in which a jury awarded $2.9 million to a woman who burned herself.
|
Quote:
|
But Carte said he has spoken to a representative of the McDonald's claims office only once. He says the spokeswoman told him they could settle with him for $50,000 to $2 million. But since then, the office has ignored Carte's phone calls, he claims.
|
I can't believe that lady got $2.9M for that regardless if it was hotter than usual.
Does anyone know what kind of profit McDonalds brings in every year?
