The issue is that a lot of stalking behavior can't easily be criminalized because it looks too much like behavior we do not want to criminalize. Further, the real issue is the possibility that the behavior will escalate into something that is criminalized, but we don't want to jail someone because of something they haven't yet done but might do -- we don't want to live in that society.

The remedies (restraining orders) are largely ineffectual in preventing actual harm because if you intend to harm someone, what do you care there is a Court order saying not to go near them? There is already a law saying "don't harm people" and you're already intending to break that, so breach of a restraining order is a big "so what".
