I don't think that is the default position in most cases. I don't work in insurance though, so maybe I am out to lunch.

Wouldn't different insurance companies have different rules leading to accidents, if those were the rules you chose to follow?
One insurance company says yield to the person on the right, the other says feeder has the right of way and you have an issue.
I would guess the traffic act would prevail, at least if it went to court.

Nope,they sure don't. All insurers have fault charts to which the all agree on. Not having an agreed upon fault chart would add months to the claim process.
And I belive Rathji is correct. With the exception of the backing out scenario and the discussion regarding right of way into feeder roads, any other accident is charged 50/50 assuming their is no independant witness backing up one side of the story.

While we're talking about parking lots, those that use a fire lane as their personal parking or waiting zone should be beaten on the spot. Not only does it make it more difficult for vehicles, it also makes it more difficult to see pedestrians in a place where there is a steady flow of them. I don't care if you're there for one minute or ten - you need a smack.

Not always and not automatically. For example any car reversing has to give right of way to other vehicles.

Some lady almost hit me today in a parking lot.
I was looking for a spot and going maybe 5-10kmh. I'm about to turn right on a corner that's obstructed by a large pickup and I see her barreling towards an open spot that's straight ahead from her vantage point. She must have been going 40kmh at least. This is an outdoor lot and snow covered, so I hit the brakes and she gives me the dirtiest look and starts screaming at me for being an "irresponsible driver".
I just laughed at her.. What an idiot

A friend of mine just got paid $1500 because someone backed into his door. God bless the lady that did it, she fully admitted it was her fault. The payout was from her insurance BTW.
