While this is a good act of selflessness by the hummer driver, and good on the insurance company for how they're handling this situation.
I just hope that this incident doesn't start a string of people intentionally crashing into other cars because they think that the other driver is about to hit pedestrians crossing the road.

Why not? If you know a car is steamrolling towards a couple of pedestrians you would just let them hit them?
Distracted driving laws are not harsh enough. Want to talk on your cellphone while driving? buy a car with flipping blue tooth in it.

I know this isn't the same situation, but I do this kind of thing often on Ogden Road.
Often impatient commuters pass on the right at intersections, when people are turning left. Of course, if someone is crossing the street, and a line of cars is forming, to someone speeding down the road it looks pretty much the same.
On one occasion, several years ago, I was stopped and wait waiting for this lady who was obviously a nanny herd a couple kids across the street with a cube van stopped in front. For some reason, I thought that some idiot might try passing those of us who had stopped, so I pulled my wheel right and put the nose of my car in the right lane. Of course, some guy in a beamer swings out to the right and slams on his brakes before hitting me and screaming obscenities, until I pointed to the kids who had come out from in in front of the truck.
Since that day, I have done the same thing a couple times and I do realize that every time I am risking my vehicle, I am fairly confident that I would not be at fault if an accident occurred.

In this particular situation the Hummer was out ######d by a douchier car, the silver Pontiac G5 which is only one step above a Cobalt or Sunfire.

Why? Because not everyone knows what their car can handle? I willing to bet that some drivers on the road lacks so much common sense, that they think their small ass Smart car could hit another car and prevent it from hitting pedestrians. If somebody does that, I'm willing to bet that the smart car is going to be the one that slams into the pedestrians.
Some people also lack the sense of spatial awareness and could think that the crosswalk is closer than it really is, and slams into another car, with the driver being distracted or not, even though that car had more than enough room to stop.
If people are going to do something like that, I hope that they do it with a clear head and some common sense, not "I want to be a hero like that guy in the hummer."

Even with your smart car example. it would be better for the pedestrians to be hit by a smart car than to have a vehicle hit them head on unimpeded.
Hmmm i just got my car2go key in the mail today. time to start cruising!

Yes, it would be better for pedestrians... but what if the cars were bigger or traveling at a higher speed? Some people are gonna get themselves killed, and get the pedestrians killed on top of that... so instead of having 4 people die, it would now be 5.
I'm not saying don't do it, I'm just saying do it with some common sense.

I think some of us are missing the point here. While I am happy that the driver of the Hummer who saved those kids will NOT face any insurance penalties, that really isn't the point. If he did (and we can all agree the court of public opinion wouldn't be kind if he did), I'd hope he wouldn't regret his actions, and wish he hadn't intervened. He saved 4 children from a speeding vehicle colliding straight into them!
If it were me, and I had to pay higher insurance premiums and have this on my record, I'd be upset, sure, but I'd be at peace knowing that 4 children were not hurt or killed. Some things are more important than money and a driving record.

Exactly. I would take having to pay more money or whatever, over living with seeing kids being plowed down over and over again in my dreams knowing I could have done something to prevent it and didn't.

I'm sure if you saved 4 kids lives by wrecking your car, an online fund would be setup which would more than cover the costs through donations.

You would hope so, but I still feel the same (granted, I'm not in the situation, but I like to think I would feel similarly if ever confronted with it). Online fund is a nice gesture, and would be appreciated, but 4 kids are alive. That's more important.
