It wouldn't be the first time. Thomas Jefferson declared war on pirates of the North African coast in the early 1800s. Essentially though, he declared war on the states that were supporting them.
I think to declare war on Somali pirates, you would essentially have to get Somalia to agree to have foreign task forces on their soil or give Somalia an ultimatum and declare war on the country if they don't agree to it.
