Yeah, was just coming in here to say this. I'm certainly no lawyer (yet), but there are plenty of instances where prosecutors determine that the only way to get a conviction is to go with the lesser charge.

Are you a lawyer, valo? I thought I read somewhere that you were.

How am I a hypocrite? Because I try not to form my opinion off of a Calgary Sun article? I fully admitted that I didn't have enough information to form an accurate description for what had happened. I am not saying you need to know every detail and read every word but to say that you even remotely understand a very complex case based upon a summary from the Calgary Sun's usually biased reporters is pretty weak and dare I say lazy.

I am, which explains my bitterness and argumentative nature.

Not a criminal lawyer, but took plenty of crim law classes and have a few friends who are prosecutors and defense attorneys. It's a much more shades of grey area than people like to pretend it is. No two cases are the same, and nothing fits perfectly within the definition of a crime.

Actually I am making my point quite clearly. You see my point isn't that this verdict/charge/sentence was right or wrong, I'm smart enough to not attempt to take a stance on something that I know next to nothing about. My point is that we don't know the reasoning for the charge pursued or the sentence imposed, and coming to the conclusion that the justice system is a joke based upon an article in the Sun is moronic. You are doing a fantastic job of proving my point.

Yep, I'm not looking to get into crim either, but I know a few people who are and they all seem to indicate that these things happen.

It's just a typical example of somebody trying to argue a stance based on emotion rather than logic. A lot of people don't realize that the framework of the justice system works to the advantage of the average citizen. Sometimes that framework is exploited, but if we started treating each case on an individual basis, without any sort of rules or guidelines, we'd quickly find ourselves in a illegitimate civil and legal quagmire.
