The phone up to the ear makes a huge difference. The stupid banana experiment proves nothing. I see it time after time after time, when people have their hand plastered to the side of their face, whichever side the hand is on does not get shoulder checked. Then there's the really cool dudes that have their right hand plastered to the face, and right elbow on the middle arm rest for that slumped over pose and those guys don't check either side.

There's no way to be sure those people would have shoulder checked in the first place.
My whole point is that holding something is about 10x less distracting than talking. I didn't claim it wasn't distracting at all.

ring ring ring *I don't answer my phone in my car, nobody is so important that they need to grab that call right away*
checks voicemail: "My god, Jimmy's been in an accident, he's fading away as we speak, get to the hospital right away...pick up your damn phone!!"
Wow, I wish I would have answered my phone, then I could have turned around and got to the hospital and could have seen my friend before he passed away.

Anyone ever tried Swype while driving... good god. I can't even text correctly when I'm sitting at my desk, let alone on the QEII.

How about this idea: pull your car over to the side of the road or into the closest parking lot and call back whomever just phoned you? Pretty simple solution me thinks.

Yeah, but that was the whole point of using a friend as an example. Your friends call you all the time, so why would seeing a missed call or voicemail from one of them cause you to pull over and listen to your voicemail or call them back?

I am not sure, when my phone rings while I'am on the road I let it go to voicemail and check said voicemail when I can. With that being said, if your concerned about potentially recieving a call regarding a friends impending death then you might want to act accordingly. But if we're going to be realistic, the example you used is one in a million, at best. If you're going to try to justify anwsering your phone while driving because of the extreme off chance that a crazy, time sensitive emergency may arise then you deserve all the tickets you're sure to get.

Friend's impending death
Beermergencies
drug deals
...and that list could go on, those were just the first examples that came to my head.

I would rather see the money spent on this subject over the years spent on drinking and driving. There should be 3 or 4 check stops every Friday and Saturday night in different locations.
The police chief has cut crime by adding police presence. One could only assume they could cut drinking and driving by adding this same police presence in a different form.

Fair enough, can't keep a drug dealer waiting I suppose. But in all honesty, I am going to laugh when I see a "Got a Cell Phone ticket - Help me beat it" thread from flameswin....and I AM going to see it.

Totally agree. At least when I'm holding the phone to my ear I feel like I'm conscious to the fact that I'm on the phone and driving and need to focus on driving.
When its just a voice in space, I get totally lost in the conversation.

The Beermergencies and Drug Deals aren't that fracking important.
And most Drug Dealers will come to you as long as you have the cash.
And the first one, most drives are probably on average 10 to 30 minutes, and the first one is extremely rare, and you'll know its important enough to pull over if they're calling you 5 times in 10 minutes.

Cell phone legislation = cash grab.
Why? Because's we've had 'distracted driving' legislation since the beginning of time (<--warning: hyperbole) and we've never bothered to enforce it. Why? Because the cost of a distracted driving ticket is +$400 as opposed to whatever paltry sum they ask for the cell phone ticket. The cheaper ticket is a cash cow because fewer people are inclined to take the day off work just to fight a small ticket. They'll pay it, and gladly. This saves the crown from spending money defending the charge in court.
Cheaper tickets handed out more often with less chance of them being contested in court = $$$$.
All the name of safety. You'll sooner get pulled over for talking on your cell phone than the jackass doing 95 KM/H in the left hand lane on Deerfoot who is actually causing the problems.
I'll admit I've almost been hit by people yakking away on their cell phones. But I've also had to dodge people who were staring at their radio, trying to eat a cheeseburger, doing their makeup, lighting a cigarette, etc.
