The Devils got punished because their Kovalchuk situation was completely ridiculous. They had 6 sub 1 million dollar years tacked on at the end on a contract that expired when he was 44.
That's in another Universe than a contract that has a 5 million year and then a 1.5 million year when the goalie is 37.

There is a huge difference between retiring and holding out, both morally and legaly, it is not Kippers fault that the Flames have been run by efftards and are now screwed.
He is not morally obligated, at his age, to move to some other city and live out of a suitcase calling his kids every night on facetime in a pathetic attempt to be part of their lives.
My respect for him would have been diminished if he put the needs of the team over the needs of his family.

The thing about the Kovy deal is that it wasn't a case of knowingly deceiving the league. The cap circumvention was public and spelled out in the terms of the contract.
If it comes out that the Flames had an understanding with Kipper that he wouldn't play out the contract, Bettman is going to throw the book at us. Kipper's back diving contract was the first one, I'm sure Bettman would love to make an example out of us.

There is ZERO chance that the NHL would punish the Flames in any way for Kipper retiring.
The negotiated Cap recapture clause in the new CBA takes care of the punishment. Kipper's contract doesn't fall under that clause, so there will be no punishment.

Why did he enter pro sports then? He's a well compensated millionaire with no clauses in his contract stipulating he has the right to not be traded or moved. My response is simple: Suck it up buttercup. You signed a contract with a lot of 0`s. Honor it.

In addition to eliminating future back diving contracts, Gary wants to send GMs a message: don't try to circumvent the cap owners fought so hard for.

There is no chance the flames will lose a pick if Kipper retires early. The NHL is not going to want to open that "can of worms". There are a lot of other contracts like Kippers out there and they are not going to want to ding all the teams for it. It will make the remaining front loaded contracts even harder to move then they are now. NHL and NHLPA do not need to go to war over this.

Really, you don't understand the difference? Kipper just screwed the Flames out of a 1st rounder or whatever he is worth now. If he simply retired after the season, there is no issue. He is trying to have a NTC when he doesn't actually have one.
