Essentially in giving no demerits, they're either saying its a cash grab or its going to be hard to enforce/prove in court. Perhaps if its just a fine people will be more inclined to just pay it instead of fighting it if demerits were involved.
Sad, really. That the government both feels the need to legally enforce specific driving habits, and that it thinks that legislation is a proper way of doing it. We had distracted driving laws in the past, but now it feels the need to "list" things we can't do.
I'm not a fan of the direction things like this are headed.
In many cases, wouldn't providing your cell phone history get you out of a ticket? Officer says I was on the phone, the log says I wasn't, so eat it.
The flipside could also be true, but I'm not sure whether the police would/should/could be able to access your cell phone records to bolster their claim on a $170 ticket.
I have no problem with it though. I use my phone sparingly in the car, and always with a headset. Never text in the car.

Probably not. Who's to say that the cell phone history you provide is the phone the cop saw you texting on? I think a judge or JP or whatever would take the cop's word on something like that.
I hope the cops go full on nazi about this. Nothing makes me want to get out of my car and punch another driver in the face more than that stupid head bob where they're going 10 under the limit, leaving 19 car lengths, and bobbing the head looking up, then looking down. Get the F off the road and go send your SO important message. Let the rest of us get to where we're going.

I can't belive people are actually refering to a law that prohibits people from operating a 2 ton machine at 100 kph with their head down adn their mind somewhere else, as a cash cow.

It is amazing how many time you see absent-minded idiocy happen on the road, only to pull up beside them at the next light and find a phone plastered to their ear. I'd rather not have the government introduce another law, but people continue to demonstrate that they can't drive properly with a phone to their ear but are oblivious to how bad they are driving or simply don't care. It is a major problem, and if this is the tool that will deter it, I'm fine with that.
I seriously wish that there was a seperate department of CPS that would drive around in unmarked cars and nail these people. They could go after all of them, from the texters to the left laners to the weaving trucks.
Or, I would approve of cops that want to work overtime, driving around in their own cars and wearing street clothes, radioing in the plates of people they see driving like f-tards, and the nearest marked cruiser can pull them over, and the off duty cop could be the witness.

i have to disagree - a few weeks ago i was behind some a$$hat on deerfoot - traffic was crawling so he was multi-tasking (i was behind him and could see his eyes in his rearview mirror and they were looking down for long stretches of time) - traffic magically cleared up and he maintained his pace of 20 kph. i was finally able to pass him, and then lose him behind me as he could not apparently find his accelerator.......
it scares the hell out of me when i get passed by a 20 yr old on deerfoot who is speeding and texting..........
