My guess would be based upon the costs associated with the H1B. Most employers would hire a lawyer for the H1B and then they are looking at around $5,000 - $8,000 (from what I've been told).

I hope that's not the case, seeing as I work at a law firm.

Maybe they just don't like me enough

Funny Story (Kinda off Topic but still talking about US work Visa's)

I was in the Immigration office at the Airport a few years back when Mike Vernon was trying to get his Work Visa to go to Tampa to work for the Lightning as a Consultant....

The Immigration officer obviously didn't follow hockey as he was going to deny Mike's application due to the fact that he did not have the required 3 years experience as a consultant.

I guess multiple Stanley Cups and years on NHL playing experience wasn't enough.

Once a supervisor had a look it took about 20 minutes to get him approved...

I have no idea. With the legal market being so slow in this economy, it's probably not a surprise that employers are taking a wait and see approach and just keeping you on a TN. It's cheaper and if they can you on an H1B there are additional financial requirements for them (reasonable expenses associated with getting you back to where ever you call home, for example).

The fact that there are 175,000+ less applications than there were prior to 2009 makes you think most employers are taking that route. If you prove yourself long term and the financial outlook of your firm looks better in the next couple of years, they might be more eager to get you into an H1B.
