Yes, the key is to prove his intent. If he picked up the object and intended to steal it then he could be charged with theft. He doesn't have to make it out the door. Although, you would have a better chance at proving the intent if he did leave the store.

Agreed. If l had a store and some punk tried to steal from it, l would not hesitate one second to beat the tar out of him if l could. Go ahead and let him call the cops for assault....that would kind of be like calling the cops because someone stole my bag of crack.

What are those lock in systems that some stores have where if a guy is about to bolt for the door, the store clerk can just lock the door from the outside with a button behind the counter, then call the police? I think those are pretty effective...

I think there are laws for protecting property, like farms or land from trespassers. I am not sure, but the use of force in those circumstances (versus homes etc) is closer to lethal force. When I read the law, it seemed like it was written a few hundred years ago and never updated. I am sure a lawyer here knows what I am talking about.

In a somewhat related story. A few years ago I was playing an online MMORPG with some friends (I think it was EQ2) and one of our party afk and didn't come back for over an hour. Turns out he answered his door to 2 guys and got pistol whipped to the ground and was forced into a closet at gunpoint. Now this guy was an ex military man and they made the mistake of putting him in a closet with a back door, right into his study where his gun was kept. He put a bullet into one of them and of course they took off running. Now this was in the US and the cops just took his statement and told him they would call if they found the guy.
He was back and playing before we ever really noticed he was gone. It took him quite a while for him to convince us he had just shot a guy while he was AFK.

Does your friend have a death wish? threatening to kill a criminal from a location you work at is pretty stupid IMO. Maybe next time he wants to rob your friend he will be more prepared to deal with your aggressive friend.

Totally true. If some guy tried to rob me or my family's store, I would beat the living piss out of him. You can't expect to commit a crime, and while getting caught in the act, have there be no reprcautions. If you are willing to commit a crime, you better think about the consequences of getting caught. And those include having your ass handed to you.

I don't know, beating the tar out of what is likely some desperate junkie over a couple Porno mags and a grape crush seems a little excessive. How about get out and never come back, your banned from the premises. I have had customers try and pull fast ones on me when I am finalizing their car loans that could cost us literally THOUSANDS of dollars, not five or ten bucks. What should I do in that case? Pull a chainsaw out from under my desk and chop the customers head off? 10% of all losses come out of my pocket so they are stealing from me right? What about these mortgage scammers? Do the banks have a right to strap them into iron maidens and have them drawn and quartered?
A beat down for petty theft solves nothing, especially if the act was never violent. If it was a robbery, that's a little different, but nobody who isn't either desperate or mentally diseased in some way steals and risks jail for no other reason than to save 5 or 10 bucks.

That's the way it is down here. Also that is why I keep a shotgun under my bed with 5 in the tube (nothing in chamber, I dont have kids) and a pistol on me at all times. (I have a carry permit)

Sounds to me like the guy got sick and tired of punks stealing chocolate bars and magazines, and decided to send a message. It's a little mom and pop place, not a car dealership or a friggin bank.
