What type of contract would this be considered? A direct sales contract or a timeshare contract? Who this be stated on the contract itself.
She is willing to pay the cancellation fee but you cant just cancel it and pay the fee.
Thanks in advance.

Or she could just honor the deal.
If there is a legitimate beef (constantly broken machines, significant change to operational hours, dirty facilities, etc) then she should be able to ask for a refund or cancellation. Any good business would make the situation right - if there's a legitimate problem.
Sounds like (in this case) she just doesn't like it any longer or realizes that she made a poor choice.....

You could get a new girlfriend who doesn't have this issue so you don't have to help her resolve it.

The surest way would be if you could invoke force majeure. So, if say, the Spa Lady in question would burn down...

Tell her to injure herself in the gym. Then, threaten to sue the gym. Settle at a cancellation of the gym membership. Easy peasy.

Tell your girlfriend to walk in and start eyeing up the girls while making notes. then have her accidentilly drop a gym bag full of sex toys, ropes, handcuffs and lye.
Not only will her membership be cancelled but she'll be escorted from the premises.

My ex had this issue of trying to get out of spa lady. This is what she did:
Apparently there is a clause in the contract where you can get out of it IF you have proof of a medical injury that prevents you from doing physical activity. She had back issues and went to the chiropractor and got a note. The gym still wouldn't accept that since it wasn't from an actualy physician, so she went to her regular doctor, told him about how she had a note from her chiropractor to get out of the gym and would like a note from him. He obliged and gave her the note. She was able to get out of the contract. Be sure the doctor specifies on the note that in his medical opinion, physical activity is not recommended. Spa Lady still tried to keep her tied to the contract, but with a physician's and chiropractor's notes they were pretty much forced to give in.

That would seem to also rule out sex so it doesn't seem like a reasonable option.

So it looks like it is going to cost you $150. I can't believe they charge people that have passed away that is just horrible!

Why are gyms so creepy with their contracts? I remember walking into a gym a few years ago and being bombarded by a couple of trainers. Next thing I knw, I had signed up... then I realized that I had no desire to go to a gym that was fairly far from where I lived and was pretty expensive.
It took me months to get out of that contract, and cost me hundreds of dollars. Since then, I've never even considered joining a gym. I'd rather pay day rates then enter a contract with what seems to be the most underhanded industry since satellite TV.

They do contracts because they know 90% of the people that sign up won't last more than a month or so. In most gyms if all members actually came to the gym they would be over crowded.

Just get really fat and bitch a lot when you go there. They'll kick you out. Or don't shower for a week before going.
