That's right. Police don't assess blame. They lay charges for traffic violations. I would assume insurance companies do take that into consideration as technically it is part of the police traffic "investigation", but insurance companies have their own set of rules to assess blame.

Leaving 2 feet isn't much of a margin; especially with current road conditions. It sounds like you cut her off.
I've been involved in an accident where the person at fault didn't actually have their car collide with the other cars.
I do respect the fact that you didn't try to drive away- but it sounds like this is going to be your fault. The fact that you did the right thing before leads me to believe you will do the right thing now- in not lying to the insurance companies and denying anything.

I talked to her over the phone the lady I talked to said she already had a brain injury and she said there might be some sort of cash statement on top of that. When I saw her she looked ok.

Did she also say she "slammed on the brakes"? Cause IMO, everyone should know NOT to do that in icy conditions... Whether you caused her to or not... had she just driven instead of hitting the brakes, if she hit you, then it was your fault. Since she hit the brakes instead, causing herself to slide, that's her fault.
Clearly her fault.

She already had a brain injury before this happened she said it might have got worst, but the thing I don't understand is how it could she get hurt because the damage to her car isn't where she sits.

ah yes...that is the big argument.....she will say that becuase she had a pre-existing injury that she was more likely to be injured. I am sure the lawyers on here can discuss Thin Skull vs. Crumbling Skull.
I would report this to your insurer.

easy....well not really, but the medical records and the doctors can discuss that. at the end of the day do what you want...but IF she can show cognetive issues.....oh baby that is a lot of cash.

Oh believe me I know. My mother is involved in one of these cases as we speak. All the lawyers have their own paid doctors. Very shady imo. Mediation is on Monday finally after 7 long years since she was hit.
