I wasn't a toddler/young child, but even at the age of 18, which is the age of majority here, I apparently needed a letter from my parents, to allow my boyfriend's parents to take me across the border, as I wasn't the age of majority there. The border agents phoned my parents to confirm that they knew I was crossing the border, and with whom and that they gave permission. That was many moons ago.

You typically need it in any case where one parent is travelling with the child without the other parent present, whether they are married, divorced or separated. I believe the only time where it is not needed is if you are divorced and it is clearly stated in your divorce decree (which you also have to carry a notarized copy of if applicable) that the parent travelling with the child has sole custody and the other parent does not have set access (reasonable access or none at all) or a restriction of mobility clause. But even then, if the authorities want to press the issue, you can be detained for not having this paperwork and the other parent/jurisdiction contacted to confirm that the parent with the child has full rights to be travelling alone with them.

It all has to do with child abduction concerns and authorities wanting to make sure one parent is not running off with the child without the other parent's knowledge. Being that this happens while married quite frequently, sometimes in relationships with no knowledge of issues, they require proof that the other parent that has parental rights is aware that the child is being moved around. Some countries, travel of one parent with a child without the other parent present is almost not allowed at all because of high abduction occurrences.

My understanding is that a parent with a child but not the other parent always needs a letter. I'm a commissioner for oaths and have done a few of those.

I recommend that the letter of authorization also includes full consent of the other parent to give any and all instructions relating to a medical emergency or treatment in the unlikely event an emergency occurs.
