What you want to do is try and apply for the new housing rental rebate instead. But in order to do that you have to meet a number of conditions. At a minimum, I believe you have to show a one year lease of the property after you acquired ownership.

I believe yours would be a Type 6 Application, and I think that means you're hooped.


The standard new housing rebate (Form GST 190) is only applicable if you are using the property as a residence or a family member of yours is and that was the first use after purchasing the property. I frankly don't understand why the government made the distinction between the two, as it basically becomes an extra hiden investment tax.

We got ours within a month of applying.

Just talked with my friend who applied for it. He said he used the form GST190.

It says "Generally you have 2 years from the date...." well might as well try to send it in. hehe

Was your buddies' also a revenue property? That is supposed to be the distinction. However, there was a time where I heard that the government was sometimes issuing rebates to owners of rental properties on Form 190. I'm not sure if it was a matter of policy or was being done in error, but it was probably around the time you were talking about. The thing is that the rebate has only been available for rental properties for a few years, and I think at the beginning it was pretty open to use whatever form because it took them a while to work the details out. It is also possible that your buddy fudged the application and said it was his residence or a residence of one of his immediate family members to get the rebate. (Obviously I would not advise you to do that. If you ever get audited on the transaction, it's probably tax evasion and you could be subject to some stiff penalties.)
