since people are on the topic anyway, I'm toying with taking a company to small claims court. I think they were shady, a judge may or may not agree. My fear is they'll run up a big legal bill and sue me for it if I lose. Is there any way to mitigate this risk?

Again, CP with endless amounts of great advice. This guy is blowing smoke and trying to bully my brother. My brother knows that this idiot bagged on a 20+ year old truck after he bought it because when he test drove it he asked (a) how loud the stereo goes and (b) can you peel out in this thing?

We'll see what this guy does tomorrow when my brother tells him no again. If a hot shot lawyer contacts him, I'll post and we can all have a good laugh at the legal bill this guy will be facing over $600 (really, as ken said $450).

I'll keep you guys posted. Thanks again.

First of all, by the time this guy spends the time and money to file a complaint it will not be worth the $600. Most vehicles sold in used condition are usually accepted in "as is" condition. If you are going to buy a $600 vehicle you should expect it to have some problems. This guy is just threatening your brother and he has nothing to worry about. Even if he did go to small claims and won, there is nothing within the legal system to make your brother pay....but that's a whole other story.
