My house is new (2003) but my pins were about 18 inches down. I rented a pin finder from a surveying company for about $20. And by "pins"- imagine rebar that is 3 times as thick with a head on the top. Top was painted flourescent orange.

Edit- and that areal map of Calgary circa 1914- you can buy it at Maptown. I did and got it framed.

You may be able to negotiate an encroachment agreement with the neighbors and the City.

An up-to-date RPR will show where everything should be. Ultimately, the City can force removal of encroachments, but more likely they will allow them within reason. You might have to offer the neighbor something in exchange, to keep the fence where it is.

You might want to question your lawyer, why the issue of the deck encroachment was not noticed when you bought. Your seller should have removed that part of the deck, or obtained an encroachment agreement.

they can be... If its a new house in a new subdivision, they're probably burried under the top soil/grass (as they were done before the excavating and therefor landscaping), but yours being in an established community, they should be ground level, unless they are covered by leftover dirt from excavating, but the builder/excavator would probably try not to have that spilling over to your property
