Reading the letter and a few minutes surfing the web and it seems evident that this isn't really as heavy handed as one might think from the article.
First off, the letter is relatively neutral IMO and tries to spell out the legal issues. Pretty standard for a demand letter from a lawyer. Did he have to go through a lawyer? Not necessarily, but Ed has the right to do so if he wants to, in order to protect his rights (PR notwithstanding, of course).
Secondly, they clearly are offering this guy the option to voluntarily shut down the site and hand over the domain name in exchange for not pursuing the matter in the courts. Again, pretty standard. Besides, as I think someone mentioned earlier, chances are the blogger would ultimately lose... publicity aside, it's probably in his best interests to hand over the site.
Lastly, this isn't a "high priced lawyer" involved -- I checked him out and he is a relatively junior lawyer (2005 call) that practices family law at a relatively small firm... not exactly bringing in the hired gun senior partner at Big Law Firm LLP to threaten little Joe blogger guy.
P.S. On the lawyer's bio (which I won't post but you can easily find if you want to), it says he's a member of the Flames Ambassadors... perhaps he's on CP?!?
