Its usually implied as a condition of employment, you don't have to print conflict of interest in the contract.

I am not sure if this has any bearing but this was not a high level management position. A Burger King employee dating a McDonalds employee would be a closer comparison than some high ranking VPs or something.

Obviously it is bigger than fast food, but it could be argued that this was a vast over reaction by the company.

Also does anyone know if a manager is permitted to ask an employee personal financial questions? IE "How much debt do you carry?"

I don't know if he has any ground to stand on. First of all, the Employmetn Standards Code is a basiv minimum for organizations to follow. Most follow much more strict policies to avoid lawsuits.

However, if he is dating a person who is in invloved with a competitor, I would say that is reasonable grounds for dismissal. The company doesn't want to risk himgiving out information.

For the record, if I was his boss, I would keep him on to see if he could get any info from the girlfriend.

Well, a lot of job offers are finalized based on the condition that a credit check passes without flags, so in that sense, the employer is already checking how much debt the prospect carries. Normally not a dollar figure, but a credit score.

When I worked for the Department of National Defense as a CO-OP student, they did all the credit score checking, but also informed me that they'd be accessing the actual dollar figures of how much I owe as well. I assume it's most likely the same for other institutions like the RCMP, local policing forces and CSIS... and I wouldn't rule it out for high-ranking positions in an organization when the role requires an extremely trust-worthy individual.

Makes sense though... if a prospect is in huge debt and is known to be in money trouble, that puts that employee at a greater likelihood of maybe doing things he/she shouldn't do to alleviate that debt, putting the institution he/she works for at huge risk when we're talking about need-to-know information being exchanged for cash from undesirables.
