I don't know if this guy is for real, but you gotta feel bad for him. I remember a police friend of hubby's saying if someone robs you make sure you shoot to kill and make sure it is inside your house and not the yard.

there was something else that this case brought to mind.

About the farmer who shot two burglers and killed one of them. The survivor then sued him!!! (it was also later shown that the leg injury he put on with a limp was fake, he was caught on tape merrily riding a bike which he shouldn't have been able to do)

Years ago I had an armed assailant come to my house in the middle of the night... The short story is I gave him a beat down and nearly killed him... I was charged with attempted murder, aggravated assault and possesion of a deadly weapon... I took the matter to a jury trial and was found not guilty... Immediately after the criminal trial he sued me civily for injuries he suffered in the altercation he created... End result, he was awarded a nominal award for out of pocket expenses he incurred (lamer was on welfare and they paid his hospital bills) but it still cost me $60,000.00 in attorney and private investigator fees between the two trials...

Trust me, I learned my lesson... Leave no witnesses, dead men do not talk!!

.....Willy

Here's a similar one. It's the third case on this article:
http://www.thewavemag.com/pagegen.ph...rticleid=23607

A lady had her house broken into 3 times and got fed up. So she booby trapped her home with electrical wires and put up signs that stated that if anyone tried to break in they'd be fried. Not long after, a cocaine addict tried to break into her house and got electrocuted to death.

The family of the deceased sued her for wrongful death, stating that there was no guarantee that when he entered the house, he was there to steal. The case dragged on to a point where the victim of the break in died. The family of the deceased continued suing her family. In the end, the judge ordered that $150,000 be paid to the cocaine addicts family, but conceded that the addict was partially responsible and reduced it to $75,000.

I guess that'll learn me to protect my belongings :P

You can't mess with OPP!

But yah, I was having a conversation with a friend and he tells me he has a coworker who lives in a condo downtown, and because her condo is on the second level, sometimes homeless people would climb onto her second level balcony during the winter and sleep there. I joked to my friend that she should wire her balcony so that anyone who tries to climb on there would be electrocuted, but I guess that's not such a good idea afterall.

So now the Cosmillos should sue Eichhorn for slandering them in the press, ie. portraying them as negligent caregivers.

Frankly I don't think that Eichhorn has a case to sue. She was hurt on the job, and her job is to be in dangerous, extreme, and emergency situations. That's what she signed up for.

She was in a life or death situation (the young child) and in the process got hurt while the child's life was being saved.

I feel sorry for her, but that's her job. It's a hazard of being an emergency respondent is it not?

Regarding the "someone broke in, hurt themselves, and sued the homeowner," it certainly has happenned in the States, but it isn't something for us to worry about. A case like that would never get anywhere in Canada. The whole concept is stupid, and treated accordingly by our legal system.
