It'd be banning the console's unique ID itself.. so returning to the store and getting a new one would work, of course the buyer of the pre-owned console is going to get a nasty suprise!
In this case it wasn't really a big deal, they just used some internal knowledge (the key for an internal test they got from a guy who's mom worked at microsoft), and then cloned the Live accounts with a glitch.
Pretty hard not to detect though, if Microsoft has X # of play testers and all of a sudden dozens or more unknown people start showing up in the private servers, well that's pretty easy to detect.
