It would certainly be nice to know a citizen can come to the aid of a downed police officer without fear of legal issues, but I still have a feeling that since a shooting was involved there would be charges ... But I'm by no means a legal expert and these are only my impressions, so that's why I threw the question out. If someone can clarify this according to Canadian law and/or legal precedent, please do. That was my purpose in asking the question.

Good old CNN ... trust them to make that the headline. Sheeesh. I studied journalism in the 1980s, and had any journalism student tried to work Bodie into that story, let alone the headline, they would have received a flogging from the instructor. It's frustrating to me to see such degradation of journalistic standards ... jouranlistic standards, hmmm, that's become an oxymoron thanks to CNN, et al.

Canada's laws are not convoluted at all.

If a citizen WITNESSES a criminal act (indictable, dual or summary conviction), one can use a reasonable amount of force to arrest or apprehend the suspect. The key being WITNESSES.

From the article (and i'm sure there is way more to this story than presented there), it appears that he got involved after witnessing the crime. At that point, he could use a reasonable amount of force, in this case lethal, to arrest/apprehend.

In heavy consultation with the crown, police would decide whether a charge was justified.

too me this is the furthest thing from vigilante justice as I think can be defined.

Floyd saw the shooting and saw Kenny running a wounded officer down with his car. He used his vehicle as a shield between Kenny and McKay and sent his kid to radio for help. So his first thought was protecting the victim. He picked up the service mans pistol and demanded that Kenny surrender, so he gave Kenny a chance to survive, but Kenny was reloading the gun which put not only the police officer in danger, but Floyd in danger as well, at this point it becomes self defense, you shoot the guy before he has a chance to finish his reload, because its apparent to me that he had no intention of surrendering.

Good job by Floyd, I'm sorry to see that the police officer was killed, and Kenny being removed from this mortal coil is a good thing.

I think the last thing ANYONE should do is drive away as fast as possible.

Call 9-11....or if you have proper situational awareness...like this Marine did...you might be able to help.
