I'm not trying to say they are all innocent but maybe some of them are. Maybe some are guilty. Maybe all are guilty.

To suggest sending people to Syria for detention before going to court is bizarre. Do you know anything about what happened to Maher Arar?
I wasn't suggesting we should send them to Syria either before court or after. I was simply making a jab at what they consider "torture" and in humane treatment. I think their definition of torture may change if they had the experience of being detained in those countries.

As for detention, just because the system is built on the idea of "innocent until proven guilty" does not mean that they have a right to remain free and run around the country side. People are remanded for many things, the more serious the charge, the more likely hood of being remanded until one is found innocent or guilty. Being held until the trial is over does not mean one is guilty.

I read that night lights are kept in each cell for safety reasons. If that's what the lawyers mean by the lights being on, then...

Also read somewhere that guards do a sweep on the floor every hour (I think?), which might be what they mean by being woken up?

Having the accused walk with their torso bent down 90 degrees seems to be a security issue... I have no problem with that.

The only thing these lawyers have really, if true, is if the guard is found guilty of sticking his fist in one of the accused's face after the accused laughed while getting searched... but like the accused, the guard should be presumed innocent unless proved otherwise.

Don't those terrorists know that night lights keep the monsters away? It's for their own safety!

I agree that there's considerable motivation for these guys to fabricate charges against them. On the other hand, there may well have been some overzealous guards who feel a bit of understandable hostility toward these guys. I know that I would be feeling somewhat hostile if I were in a room with them.

Also--if the U.S. didn't have those problems at Guantanamo and Abu Ghraib, it seems to me that it would be easier to dismiss their complaints out of hand. Just pointing out that by not holding themselves to a higher moral standard, the US gives ammunition to the enemy.

And jofm--you don't need to send these guys to Syria to get tortured--sending them to the US would probably work just as well.
