Company I work for only has salary positions for hired on employees but they dont pay any OT. Employees are expected to work extra time when needed and then bank it to get extra tome off but everybody is so busy that hardly comes to fruition.

This is why I stay an embeded contractor and get paid overtime.

I would think that you should at least get banked time off.

I might be lucky then...

I am salaried but no overtime.

However my manager is not a clock watcher...

On St Paddys day I told him I was leaving early to meet friends for a pint or two.

How I manage my time, he said, was up to me as long as my work commitments are being met.

If I end up working extra hours on a project, I am encouraged to just take a friday off to compensate...no need to log hours.

This method has worked for me for the past 20+ years...

If they are not on that list, they are not exempt. Keep in mind that "Professionals" is not a blanket category for any office worker. It is specifically the professions listed.

I've been at multiple employers where individuals on the list of professionals could be in effectively the same role as other people that aren't on the list. Sometimes additionally complicated because there are regulated professions in Alberta that aren't on that list. The 2 approaches I've seen:
- Everyone gets time and a half overtime until you reach management level.
- Professionals can bank overtime on a 1:1 basis, technologists/technicians get time and a half overtime, again switching to salary at management level.

Are you CIPS accredited? Based on my understanding, that's the only way to be officially considered an Information Systems Professional in Alberta. If so then your employer doesn't have to pay you OT, but if you're not CIPS accredited then they should be... But I'm not labor law expert so I could be wrong.

Yeah, as with any government regulations/laws, your employer can establish their own rules that are more generous than what's in the code but they can't take away rights that are in the employment standards code.

Vacation entitlement is a perfect example of that. In the code, your employer must give you 2 weeks of vacation after the first year of employment and 3 weeks after 5 years. Today, in Calgary, a lot of companies are going to start at 3 weeks, and many are even starting at 4.
