Have they informed you that your walk through's will occur on the same day as possesion day? That didn't sit well either.
|
Our possession date is mid-week, and we aren't in any rush... living with my parents again... (bonus in some places, not so cool in others). I don't think that will be a problem for us, but I can see how it could be.
I'd like to be kept up to date on this issue tho, and any other issues... we appariently have a vast majority in there .

I am on RockyLedge Cres. and they better not make the remaining phases look so out of place to the first phases. I am already passed that access to that condo complex is from Rockyledge St. When we bought our house we were told access would be from Eamon Road.
Would someone please burn down the little yellow, weed infested house, with a partially built fence, and the 2 fur ball dogs, which I may point out is not even close to the required architectual controls of the neighborhood. (Corner of RockyLedge Cres and St.)

I was told June/July, I got late August, and many got September. No big deal for me, but for those trying to sell a place it must have sucked.
|
We were told end September for Phase 4, just got word it's late October. Bah well. [/b][/quote]
Wow.. I'm already in phase 4
Although I know the unit above me isn't even close to being done, so no suprise I guess. I really wish they would stop working on it at EIGHT IN THE fataing MORNING ON WEEKENDS THOUGH.
I get cranky when I get woken up too early.

I forgot though that phase 4 is both buildings that share that foundation. I'm in the 2nd last one when you drive in, I'm guessing you will be in the last one.
Good choice taking the Hamrlik unit as well

Hi Tony, regarding the question from the buyer of a new construction condominium in Rocky Ridge...
Buying into a condominium before the building is constructed comes with risks such as your reader has outlined. Typically the Purchase and Sale agreement states that there may be changes, delays or as in this case a require to register by a certain date or the project will not move ahead. There are often sales tests to be met as well. It is important that buyers of new construction condominiums have their lawyers review the Purchase Contract and that they have the document package reviewed by a company like ours - Condo-Check before they remove the condition to proceed. They then will be aware of what is expected and what the risks are. This gentleman has expressed the frustration of experiencing such a loss quite well.
Cheers! Bernie Winter

Hi,
My name is Tony Tighe with Global TV in Calgary.
I am the consumer story and wondered if you could read this email from one of our viewers and advise me on what rights this person has or if this type of situation happens a lot.

Meh - Condo Check is grossly over rated. I've been the the president of the board at my condo for the last 3 years (oooh the shame, I know) and have learned a fair bit about how things run at one. My g/f bought a really old place and had Condo Check run a report. Heck, I was the one asking for specifics about the Reserve Report that looked fishy and noted that they were underfunded. Condo Check seemed to have run off a standard boilerplate report, changed a few things from the last time they did, and charged her $500. I've heard they've made some staff changes, but from my one experience I'd say they're better for someone that has zero housing or financial knowledge.
Got to love the shameless plug from Condo Check to Tony there...
However, Bernie's right in the regard that a properly worded P&S agreement usually has some sort of escape clause in it for the builder in the event of unforseen design changes. At my condo it actually worked in favor of the buyer - the 2nd floor people got huge 500 sq ft patios over the enlarged parkade! So legally Streetside is fine, but that doesn't make them any less morally reprehensible.

Exactly, using the much greater resources of a company to screw a customer.
I still think you should send a letter to the owner and his other cronies on that board, saying you understand that legally he probably hoodwinked yourself on this one but morally he is a snake and should be ashamed of himself.

Update:
I called the General Manager of Streetside to find out the specifics about why they cancelled phase 5 and got some more info. It basically comes down to the slope. The farther down they have to dig, the farther back into the hill they have to dig. It got too expensive and dangerous.
The reasons are understandable, because people do screw up. However, I am still upset that Streetside didn't do anything for the customers that got screwed. I was calm polite when I called GM and at no point lost my temper, but the dude kept talking about the escape clause and how it was beyond their control. He was trying to cover his own ass from a lawsuit. I wanted to know why they didn't do more to keep the customers (offer more compensation). He thought $2000 of free upgrades was plenty. The fact that I had to pay another $35000 for the same unit in phase 6 didn't mean anything to him. He was more focused on how much Streetside was losing because they had to re-design phase 5. My heart bleeds for this corporation *sarcasm.
Bottom line. Streetside sucks. They don't care about the customer and it starts from the top. Tell your friends and family. Spread the word.
On another note: I found a new place just off the Red Mile. Sweet.

I've gotten a lawyer friend to review my contract...yup, nothing more I can do. All I know is, Streetside Development will never again have my business.
On a brighter note, I have have found a place at Copperwood. Developer is Sandlewood Developments Ltd. Anyone know anything about them?

Streetside made global news last night. Seems like they pulled another Blue Sky in Varsity. Citing a re-design, the nulled several purchaser's contracts and refunded deposits. Then 2 weeks later they declared it a go again, and offered the original purchasers an option to buy again.... at $40,000 more.
Now that's sleaze. My developer screwed me, but not this bad by anymeans...

I just got a claim response; one that they requested and admitted fault for the cause, and was turned down after I submitted it. Apparently I was deficient in not realizing my interior storage locker would flood and should have taken measures to stop water damaging my possessions inside. We dismiss the case of the armed robber who shot you sir, due to your lack of diligence for not wearing a bullet proof vest!
I'm going to take this to one of the consumer spots on global or ctv before I go the legal route.
