If there are no charges being laid, does this not become an ethics issue which goes before the CPSA tribunal? I have very little confidence in these hearings. He may be able to force his way back into a license with a good lawyer.

Not it doesn't. It shows how important it is for police to follow due process, which is a fundamental must in a just society. If you want to be upset with anything in this case, it's not the legal system it's that a police officer messed up his investigation.
