Just a follow up:
Got a call from a drainage tech with the city of calgary and he said you can plant so long as it doesn't interfere with the drainage of the swail or damage it. It's the homeowners responsibility to clean it and I think fix it. Flower beds that change the grade or retention walls are a problem because they affect proper run off. But i guess technically you should be 1.2 meters away from the center of the swail.
I've spoken to many people at the city and it sounds like this isn't a hugely enforced bylaw. For the most part people are considerate.
