If convicted, I would hope to see him deported as well. I have zero time for domestic abusers.

The legalities of an active player facing felony charges will be interesting though. Particularly any restrictions on his movement.

How does it work for NFL players? I've never thought about it, but could this be a reason that Toronto never gets an NFL team? I wonder if they've ever run into issues with their London games, or if they just don't send the Bengals/Cowboys?

Interesting with respect to immigration issues. Don't see why he wouldn't get bail or have a restriction on travel within the US. I'm an immigration lawyer and I would counsel someone with these pending charges in the US to avoid travel to Canada. It's been a real problem for some CFL players who are American citizens.

Well that's different since nearly all NFL players are American. They have to take them back. But Canada or Britain could, of course, deny entry.

What I am thinking of was Bob Probert's legal issues. He was banned for a time by the NHL due to a cocaine arrest, but when reinstated, he never traveled with the Red Wings on Canadian road trips for fear that if he left the US, American authorities would refuse him re-entry. I wonder if US officials would think the same here while the charges are pending. If he crossed into Canada for a road trip, count it as voluntary deportation and wipe your hands of him.

Yes, I see three issues. First, I expect he posts bail and usually you aren't allowed to travel out of the state (or province) you're in. I can see them not imposing that condition but asking for your passport so you can travel to Canada with the team is really pushing it. Travelling to Canada requires the passport, requires Canada to waive his inadmissibility and then I suppose there is the risk that the US wipes their hands clean but I doubt it. They will want their pound of flesh first (and deservedly so if he is guilty).

Yeah, in that case, I can't see them not taking his passport. That rules him out of any roadie north of the border. It would also force him out of contention for the Olympics.

From the Avs' perspective, it would force them to recall a third goaltender for those trips

Does it get to that point? Or do they suspend him with pay pending the outcome?

Is it worth the hassle, or do the Avs take a no tolerance policy to send a message to the kids on domestic abuse?

Is there anything like the NFL in the NHL CBA where a player can be realeased due to detrimental actions? Without a court conviction?

Wonder if in that monster document there isn't anything tucked away for such an occasion.

Article 18-A in the CBA deals with discipline for off ice conduct:

Whenever
the Commissioner determines that a Player has violated a League Rule applicable to Players
(other than Playing Rules subjecting the Player to potential Supplementary Discipline for On-Ice
Conduct), or has been or is guilty of conduct (whether during or outside the playing season) that
is detrimental to or against the welfare of the League or the game of hockey, he may discipline
such Player in any or all of the following respects:
(a) by expelling or suspending such Player for a definite or indefinite period;
(b) by cancelling any SPC that such Player has with any Member Club; or
(c) by imposing a fine on the Player not exceeding the maximum permissible fine
under Section 18.7(b).

Under the Collective Bargaining Agreement, Gary Bettman has the ability to suspend him while under a criminal investigation. It is at his discretion.

How about we all just wait to hear all the facts before jumping to conclusions....
The guy went to practice this morning after allegedly doing these crimes last night... then turned himself in later tonight, doesn't scream guilty to me, even following him on twitter, something just doesn't sound right about it.

Sounds like he knew he did something wrong, and is actually being a man about it.

But kidnapping and assault? Oh boy. And he's not a citizen.

I hope pro athletes don't get any lighter treatment than equivalent non-famous offenders. Of course, I'm sure the judge will find a way to avoid deportation.

This is certainly shocking, but he is innocent until proven guilty. I'm not a lawyer, nor am I studying law, but I figured I'd post these on top of what Drury18 posted.

"Third degree assault is a Class 1 misdemeanor, and the only assault charge that is not a felony. Third degree assault does not require intent, but rather that a person knowingly or recklessly causes bodily injury to another person or, with criminal negligence, causes bodily injury to another person by means of a deadly weapon. Third degree assault is an extraordinary risk crime that is subject to the modified sentencing range.


Third degree assault is commonly charged in situations involving minor physical altercations that do not involve apparent injury but do involve some degree of physical pain. Third degree assault is often charged in situations alleged to involve domestic violence, for example when a wife says that her husband hit or pushed her, or vice versa, and it hurt."

"According to C.R.S. 18-3-302 a person commits second degree kidnapping when s/he seizes and carries any person from one place to another, without his consent and without lawful authority; or s/he takes away any child below 18 years with intent to keep or conceal the child from his or her parent or guardian or with intent to sell, trade, or barter such child for consideration."


It being a Class 4 felony means there was no sexual assault, robbery, and no deadly weapon was used.

IIRC, his parents moved over to Denver from Russia recently, so his parents are here and I am fairly certain he is married too. Does he have a child? I'm going to avoid speculating what happened, because what's the point really.

I would bet that his season is over, even if he posts bail they won't allow him anywhere and he'll probably have to turn in his passport.

The optics for the NHL and the AVs pretty well dictate that he will be suspended until this is cleared up.

This isn't the CFL where people with felony assault charges are allowed to play and the court date is pushed off to the end of the season.

I was looking up a few more law sites for definitions and came across one thing that said this could be charged for something like there was an argument in the kitchen, Person A grabs Person B and takes them into the living room or Person A pushes Person B into another room while arguing technically moving them to another place. Or if Person A picks up and removes Person B from a place, such as placing someone from inside the home outside the door of the home (i.e. kicks them out by actually grabbing them and removing them). So it seems like this is a very open definition charge and it may not be the classic "kidnapping" that everyone associates with the term.

His mother has been over since late 2011, father since early 2012.
