I am not familiar with the Italian court system and the article didn't say, but is this going to be appealed to a higher court?

It's a ruling that shouldn't be made in the first place, whether or not it gets overturned.

True, but I would feel better if it was from some crazy rural judge who is going to get his hand slapped by a higher judge.

Given the "facts" of the case, the judge made a logically sound decision. It's the "facts" that are wrong.
