Could be she just misses your brother when he's not around.
My brother's cockerspaniel just mopes around or sleeps whenever he leaves her overnight with family. Then once he picks her up again, she is glued to his side whereever he goes.

To pick a new home wouldn't do any good because she is happy here with the other dogs and the kids, just not the dog she used to be, again reiterating, I feel that this is due to the house-bouncing. And I'm assuming there is no actual law that we could get a loophole to make him sell her to us because he's being a 'negligent owner' and doesn't man up and keep her. Cause if there was I'd probably go for it!
Thanks for the tips though! I do appreciate it and take everything you say!  I adore her so much and my boyfriend desperately wants to buy her off my brother but he refuses and it really makes me upset to see her be treated like that. I feel if it's your dog, you take the responsibility, however that is not her case right now and we keep trying to buy her.

That's like asking what the difference would be between three 14 year-old teenage girls and a 35 year-old woman.
If you don't know that then you probably shouldn't be backyard breeders. You've got "stereotype" stamped on your foreheads. Find some other way to make some money.
What sort of magic pixie dust did your brother sprinkle on you and your mother to get you to take Chelsea for five days a week? Stop enabling him. Tell him its your place or his place and nothing in between. Or just don't take her back to his place one day.
And maybe tell him he's being an A-hole.
And now . . . . . I've got other things to do.
