As to the OP, pretty cheap move on your part. I don't think you can cancel a verbal contract by leaving a voicemail.
I would do this if I had drove to work today, however as a latte sipping Sunnyside resident I rode my bike to work. So no can do...

Pay for the Cake and re-enact the American Pie scene in the middle of the of the store, as people stare in shock at you hammering the cake you can yell out so this is what $$$ feels like.

They might actually appreciate it, if you'd be polite about it.

Oh, I can agree that cancelling on them via voicemail is ######y. I think phoning someone 80 times and harassing their voicemail is a douchier move. I was indeed going to go back and buy the cake, but not after these antics.

Just pay for the cake.

I never custom order if I think I might have to cancel, as soon as the first ingrediant hits the kitchen counter there's no take backees.

How is it unsellable? They can just scrape the writing off it and sell it. Or mark it down and sell it with the writing on it.

It's not like he asked for ingredients to be added/removed. The cake will still taste the same.

You should tell him to stop calling you or you'll start calling him all day long to stop calling you. Then hook an old school modem up and have it redial him all day long.

I walk past this place every day, the dodgy persian rug place, the new age organic green peace bike shop, and the weird teenage dropin druggy place. I may go in and try to buy it.

It looks delicious and now I have a reason to walk in there

On a more serious note, they didnt deliver the cake in the time frame promised (2 hours) instead they took 4 hours. I have to side against most users and say I dont think you are obligated. You called 30 minutes into the 4 hours and left a message to cancel.

The only thing is if you ever plan on going back, the owner might give you the "no soup for you" line, so you have to ask yourself, how much does your gf really like these cakes.

How can we be sure the cake wasn't ready within the original timeframe?

This part of the story isn't clear on it, how can we determine that the cake did indeed take 4 hours and not the 1.5 to 2 they told him? Perhaps the message was left at 8pm after they waited for a while and wondered where he was? Now if the message had said "We've had your cake ready since 5:30 and are wondering where you are?" that would clear things up nicely.

As it stand now

Since they made the cake to order, what your saying doesn't matter. Its not like they pulled a cake out of the freezer and icing it up. They made something that isn't commonly ordered.

You order a custom anything, the minute that you do that, your pretty much on the hook.

The store was stupid for not demanding a deposit or pre payment.

This would be like me going to subway and ordering a ham and cheese sandwich with Horse radish on it, then not taking it and expecting Subway to merely scrape it off.

Once again I'll ask the question. How is it unsellable?

That would be a valid analogy if a sub tasted the same with or without horseradish. Oh, and if you asked for it and then told them before they started making it that you don't want it after all.

I assume when you leave your number with a custom cake place they call when your cake is ready for pickup - I guess its possible Yamoto is run like a pizza place where its your responsibility to come and pick it up after the owner says it will be ready (2 hours). Its completely possible it was ready in 30 minutes and waited 3.5 hours to call but I think it being late is more likely IMO.

I dont really know how this place works, had he gone there at 6 and it wasnt ready would anyone's opinion change? I can only comment on the facts as they are presented, but with the look of the cakes online (especialy the white one with blueberry and strawberry) I may have to walk in and buy one.

I dont think there is an obligation to buy it, but as its only $40 I would buy it and have good cake for breakfast lunch and dinner for the next couple of days

A scraped cake, how is it sellable?

"Why is this cake discounted? Well we had to scrape the icing off after someone ordered a custom cake and then canceled"

Anytime I've ordered something custom, its the same message, and thats no refunds on cancellation, we're making the effort to make something to your specific specifications.

It's potentially unsellable - how on earth is that hard to understand? It's a perishable item with somebody else's name on it. Can they change the name? They probably can, but now they're still stuck with a custom-made cake that's basically only going to be fresh for one or two days.

The bakery should really take a deposit.

I own a shop that makes custom items. Every single time I don't take a deposit (which is basically never now) some flake screws me.

Everything is potentially unsellable. But to declare that a fresh cake in a cake shop is totally unsellable is asinine.

It's dead simple. I've seen this happen to plenty of birthday cakes.

As opposed to the other cakes that they have in their store that are similarly perishable?
