Was 3 month lease then month to month. She advised the landlord at the begining of the month that she was looking for another place and would be out mid month. She ended up leaving about a week ago.
I am fully aware of the rules and have advised her to now wait out her 10 days. I think the issue is how it is being handled and knowing the landlord doesnt have the money but is relying on someone else's DD.
Also brings the question as to what complications could arise as It was month to month starting aug 1 and no further contracts were signed.
At the end of the day I guess it's none of my business how my friend handles it so I should avoid getting involved.

Maybe contact one of the local media outlets and have them look into it and do one of their slow-news-day investigative stories. They seem to get answers and results.

The son of the landlord was the HE
The tenant was the SHE. The son of the landlord was only to use the bedroom space.
(what a f'd up tenancy situation this sounds like. I'm not giving any advice, but agree with the general consensus.)

Your friend should have given 30 days notice and if giving notice during a tenancy month, the notice wouldn't be effective until the end of the following tenancy month. In effect the landlord may not have to accept termination of the tenancy until the end of September if notice was given in August. (Not negating that the landlord sounds like a deadbeat who spent the deposit)

You can give notice on Aug 1, that you will be out at the end of Aug. On Aug 2, the earliest date becomes the end of September.
So, "beginning of the month" could easily still mean that leaving at the end of August was acceptable.

If she gave notice on the 1st and paid the August rent in full, she hasn't really done anything wrong, although, I would think that should also give the landlords until the 10th of September to refund the DD.

Yup, that's what I was thinking too. If August's rent was paid in full, DD would not be payable until Sept 10.
Sure, it sucks, but if we are going to follow the letter of the law...

It's also the added wrinkle to the whole damage deposit thing, sounds like it was more of a "shared accommodation" than a legit suite rental. Which possibly throws some of the standard landlord/tenant rules out the window.

Update: Spoke to my friend today and its now been 10 days and she was to meet the owner for it back. The owner told her to wait until Sept 1.
I have a feeling there will be quite a few extension requests now lol.
