In fairness though, anybody else in that position would be in that position. Which is why a third party ruling on this makes by far the most sense.

Very true, but I dont mean in this specific case but also in general. Besides, I thought we had that already, didnt an independent arbitrator cut the suspension down? And now we're here.

Best to just allow a third party make the ruling and stay clear at this point.
One thing that I would find curious about the arbitration clause is that the league constitution clearly contemplates the NHL as being American. It stands to reason that the league would operate under American law for such a hearing, even though all parties are Canadian and the incident occurred in Canada. I don't see that flying either.
|
Choice of law clauses are often strange. I'm not so sure they even apply, though, aside from the law concerning the actual agreement. The law about the tort of negligence (or battery) would be Alberta law because the incident took place here. So if I get into an accident here, it's Alberta law. If I get into a fight with my insurance company about the coverage, it depends on what my insurance policy says.

Looking at that Yannic Weber video where he creams Henderson, isn't it peculiar that he also puts his hands up as he was startled....? He looks like he kind of launches himself into Henderson too, the same thing that was levied against Wideman by people who casually follow hockey and don't understand that on two blades your balance point is completely different than on dry land and in shoes.
Anyway, for what that's worth.

Henderson looking for a lottery ticket through a let's sue everyone lawsuit. Really can't stand anyone like this, classic example of greed.

Maybe Henderson should learn to look where the f*** he's going. That Weber one is brutal, he's looking right in that direction and practically hip checks Weber. Then the Wideman one, "I think I'll skate backwards through this extremely high traffic area, surely everyone will get out of my way." The Wideman one is obviously excessive but whoever said it's not in the job description to get laid out, it IS in the job description to stay out of the way, the players have other things to worry about than dodging some blind dumbass from neither team. Then he tries to sue everyone because he's an idiot.

"Accidentally". I lolled. Ok I'm sure he didn't mean to crosscheck a referee but he would have crosschecked a player so there's no accidents here.

....obviously... that's the whole point of him filing a lawsuit asking for monetary compensation.

When did society stop debating differing views in a respectful manner and start attacking other opinions by humiliation and insults? Surely we can be bigger people than this? If you disagree with someone, why not state why and debate the merits of each other's arguments instead of this drive-by attempt to belittle someone for an opinion you deem as "terrible"...

Ok, I'm sure the Flames/Wideman/Henderson appreciate your offer to settle this dispute. Please send the cheque via bonded courier.

Some opinions warrant thoughtful discussion. Some opinions are ####ing stupid and deserved to be called as such. This is a case of the latter.

I personally think it was an accident, but I don't think being an accident necessarily removes responsibility or the need for compensation. Let the lawyers figure it out. I don't see why fans are so emotionally involved.
