Unfortunately you have to be in the right situation to purposely tank. The Avs did it perfectly last year by not dumping a bad coach, even though everyone knew they should.

I thinking about how I can make it more fair... If you've had a top 5 pick 3 times for three years straight, you will be moved to the 14th draft position (the last non-playoff draft position).
If there are two teams that have had a top 5 pick 3 times in three straight years, then the team with the least points between the two get slotted in the 13th draft spot.
The other non-playoff teams get to move up a draft position or two, depending on the cirumstances.
Feel free to tell me what could go wrong with this.

Those teams that you are moving to 14th are going to suck for a long time and owners don't want teams that suck for long periods of time because it kills markets and creates huge headaches.
I think a lot of this is because the oilers are the team people see drafting bad, if the Flames are bottom 5 the next 2 years after this you think you are going to be happy to try and fix that by getting guys that are almost assuredly going to be non difference makers at the NHL level?

At least tanking in the NHL is not as bad as it is in the NBA. The way those teams gut their roster and mail it in is atrocious.
The point of the draft is to allocate talent to move the league towards parity - poor teams get first crack at best talents. It is then up to that team's management/coaching/players to improve and make playoffs/contend for the cup.
If the aim of the draft is talent allocation to weaker teams, then the system cannot change too much, but what needs to be dealt with is tanking. It is a grey area, and hard to enforce, as you do not want to take away the ability of declining teams to get value for their remaining quality assets (since this dilutes the talent pool in the playoffs), but at the same time, you want teams to play for a win every time.
Personally, if the penalty for winning late in the season is a lesser chance of #1 overall, and perhaps a slightly lower ranked prospect, but the team maintains a culture of competitiveness and desire to win, which would be needed to return to contention, I would take winning over tanking. Find a clear way to identify teams intending to tank and appropriate penalties - it is much harder than it sounds.

Not sure where I was doing that but that said I think the only way to "tank" is at a GM or above level.
I guess a coach can play his crappy players more or keep guys out of the line-up but unlikely they do that since that will kill their career.

I don't blame NBA tanking at all. 1/5th of your on floor presence for 40+ minutes a night is a huge swing if it's a star. In the NHL a single player isn't as valuable.

We will get a big skilled defencemen(fleury), or a big scoring winger (dal colle, Richie, or Perlini) no matter where we pick. Either way I'm happy really. I don't see as huge of a difference between dal colle and the others.

It is. Obviously you need to make the playoffs to win the cup, but it's also likely that just making it in as the 8th seed is a road to the last eight Flames seasons.
