Not at all, it's about shaping the perception of the people involved and the reliability of the testimony about them. The prosecution will do everything it can to paint them negatively, the defense will do the opposite. Anything that is admissible under the evidentiary rules can, and should, be used.

Maybe this thread should be re-titled, Humanity is Dying
http://www.bbc.co.uk/news/uk-england...yside-22155807
Quote:
Three teenagers who murdered a homeless man in Liverpool for a dare have been given custodial sentences.
Liverpool Crown Court heard Kevin Bennett, 53, was attacked as he slept outside a supermarket on 17 August.
He suffered a fractured eye socket, a collapsed lung and a broken ribcage and died in hospital six days later.
Brothers Connor and Brandon Doran, aged 17 and 14, and Simon Evans, 14, were told they would be detained until the home secretary approved their release.
Passing sentence, Judge Clement Goldstone QC, the Recorder of Liverpool, said: "I think it is a desperately sad reflection on this society that each of you was party to serious violence purely for the sake of it."

Oh I agree disagree. The world and our neighbourhoods are much safer, or certainly not much less safer.
But it is sad that in a time in ever increasing enlightenment, the darkness still fights back.

I love it how Anonymous was going to out the 4 boys, when one of them wasnt even at the party. I guess you cant expect much from a bunch of Mountain Dew drinking wannabe script kitties.
And now when dirty "facts" enter the picture social media is no where to be found. Just because some kills themselves doesnt mean someone else is to blame. I know that wont go over well on this forum where no one seems to be accountable for their own actions but it now seems pretty clear what happens.

Back in university this happened to a good friend of mine.
She goes to a party. She meets a cute guy that seems nice. She flirts with him. They have a few drinks together. She says it is time to go, so he offers to walk her home. He says his house is on the way so he'd like to stop in and check if his new puppy is doing okay. Well, who can turn down seeing a new puppy? So she goes in... plays with the dog. The guy offers her another drink. Well, one becomes two, two becomes three and soon she is so sloshed she blacks out. She wakes up the next morning, naked and in the guy's bed. Yes, she had been interested in the guy, but she's not the kind of girl that sleeps with a guy on the first date.
IMO, the guy is a rapist. There is no way that she was in any condition to make any kind of informed decision on consent.
But she told me this story on a private IRC channel (yes, early 90s Internet... w00t) with me an one other friend. The other friend took the other tact. "How could you have been so stupid to put yourself in that situation? Knowing that you are half in the bag, you agree to go to the guy's house? Agreeing to another drink while at this guy's house? Getting so hammered while alone with a guy you barely know?" If he had been in the same room with this other person I would have bopped him one. That was the last thing she needed to hear. True? Probably. Was it the right time? Probably not.
In any case, she didn't bother going to the police. It would have been "he said, she said" and she couldn't remember what happened to have much of a story anyway.
So, in the link above:
- Rehtaeh was flirting with the boys (uh, so what?)
- Rehtaeh refused to leave the party so that she could hang out with the boys (uh, so what?)
- Rehtaeh couldn't remember if she said "No" (she was so drunk she probably couldn't remember anything that she said.... IMO even if she said "Yes, give it to me! All of you!" she was well beyond giving any kind of reasonable consent given how much alcohol she had had)
Even given the other side of the story, the boys are still scum and deserve everything that has been coming their way.

The one I just gave above? Absolutely. What brought the story back to me was that this friend just contacted me on Facebook, 17 years after we lost touch. What makes you doubt it? Sadly, similar stories happen every single night in every single city.

Arrests have been made, no mention of charges
Quote:
Two males were arrested Thursday in the case of Rehtaeh Parsons, the 17-year-old Halifax girl who died following a suicide attempt in what her family says stemmed from months of online bullying after an alleged sexual assault.
The RCMP and Halifax police said Thursday they arrested two males at their homes in Halifax at around 8 a.m. and took them into custody where they were being questioned. The Mounties did not release further information on the males arrested, including what they were arrested for.

Good, throw the book at em.
Oh my god you might be the coolest guys on the internet for your ability to drive a girl to suicide, but in prison your just another number and your whip smart (to you) cracks doesn't get laughs in prison and a smiley face on your cell door, it gets you "corrected"

They can't make the rape charges stick, but they are charging them for putting the photos they made of the rape out on the internet. "Distribution of child pornography"

It would be quite awesome if they sought those full 10 years... nuke sexting in its tracks. Realistically, it will be maybe 18 months and community service?

Good even if they get lighter sentences (which they shouldn't) that sex offenders tab follows you for the rest of your life.

There's a pretty big difference between distributing child pornography and sexting.

They have charged one of the 18-year-old males with two counts of distributing child pornography and the other with distributing child pornography and making child pornography.

Except for the part where a Calgary teen was charged for distributing child pornography for sexting.
