Obviously an investigation would happen in that case. I've had a police officer tell me here that if someone broke into my house basically do this:

1) Warn the person that you are armed with a firearm
2) the weapon (more of a secondary warning) If you have time
3) give them one more warning to get down on the ground
4) if they attack or come at you then defend your life

Now here is the disgusting part

He also said if you wound someone make sure it is center mass, if they survive they could sue you for medical bills. I'm sorry, I love my life, and my fiance. I still struggle with the idea that if it were my or Katie's life or his then I would have to end his. I don't ever and I mean ever want to point my weapon at someone out of aggression.

I've taken Katie to the firing range and showed her how to fire the shotgun and pistol. She is good enough with the shotgun and horrid with the pistol. I will keep taking her for practice. She is an anti gun type of person but understands that might be the only thing that saves her life or stops someone from raping her. It's a sad world we live in today, but you have to protect yourself.

Right now I work all kinds of weird hours all night to 2nd shift or 3rd or even 16 hours straight. I'm also a full time student so I cant be at home all the time. So we have a Mossberg .20 gauge loaded up with one in the chamber and 5 in the tube under her side of the bed. When I get home I put my pistol in the night stand next to the bed and it stays there until we leave the house.

when we both are gone I take all the ammo out of the shotgun and lock it with a chamber lock and put it in the safe.

Gun safety is really important to me, but it does take a lot of responsibility to carry one. I'm not some John McClean running around going nuts shooting people, I have a very expensive holster that you wouldn't know that I every have it on me. I've only pulled it out once out of fear (earlier story) and had to disarm myself twice when I was pulled over.

The police man walked to the car and I explain that I have a weapon that is loaded on me and the reason why I haven't got any of my information out was because I wanted him to know. Then he asks me to get out of the car ( they most of the time have their pistol out for their own protection) so I get out and tell them where it is and they disarm the weapon. He then takes the pistol to his car and runs the id number and takes my pistol permit and the rest of my information.

This isn't something to take lightly, I wouldn't kill someone for a $100 stereo, or 90 % of the stuff in my house. But as soon as someone would endanger my pets or fiance or family then I would do my best to defuse the situation before I would ever pull the trigger. I never ever ever ever want to take someones life.

I hope this makes sense.

It does make sense,I just think if they got to lenient certain people would take advantage of the system.

Obviously, There was some articles about people breaking into a place of business and getting injured from falling down the chimney. They sued and won because the business owner didn't have a screen in it or something that would stop people from falling down. People that are breaking the law I.e burglarizing something should have their rights taken away right away. If they are assaulted in the process then they cant do a dang thing.

No,what i mean is,person A (homeowner) doesn't like person B.
Invites person B over. person A shoots person B claiming person B was an intruder threatening him. That's what i mean by some people probably would try to take advantage.(probably very unlikely but if there is a loophole people will try it)

Ah, sorry about the misinterpretation.

Well the issue is that already happens here. It's called murder, the police will have to investigate what really happened.

Bump. Again.

Trial date set for February 10 and 11, 2011. Also, the accused Mr. Singleton and his family have set up a website where you can express support for his defence: http://honestjoe.ca/

Does anyone believe he didn't smash the dude in the face with a hatchet?

I'm assuming this isn't so much about if he got hit but rather if he was a threat to the defendant and his wife when he was hit?

I doubt any jury will convict him - I wouldn't if I was sitting on it.

The Crown is proceeding by way of summary conviction. A jury trial isn't available to the accused. The decision will be made by a Provincial Court Judge alone.

Sounds like a complaint against a police officer... those complaints are entertained daily.

It would be nice if this was the case that took a hatchet to Canada's weak self defense laws.

You are the lawyer so you would know better than me but isn't the question does anyone believe that he wasn't 100% justified in smashing the dude in the face with the hatchet?

The crown going the cheap route and going with the summary judgement seems to indicate that they know that nobody in their right mind would convict him so they hope that they can get some judge to convict on the basis of some BS legal reason.

Bump.

http://www.tabertimes.com/news/local...sentenced.html

The perpetrator who was allegedly assaulted by Singleton was sentenced at the end of January. CTV Letbridge's twitter feed said the Singleton trial was supposed to take place on February 10 and 11 but I have not been able to find any news reports to that effect.

Tough on crime, he got grounded.

Quote:
Luc Roy, 19, was sentenced to an 18-month conditional sentence order followed by one year of probation by Judge F.W. Coward.
Roy will spend the first year of his sentence under house arrest, followed by six months, in which he must abide by a curfew between the hours of 10 p.m. and 6 a.m.

Bump again. http://www.cbc.ca/news/canada/calgar...s.html?ref=rss

Singleton was permitted to enter the alternative measures program and successfully completed the conditions assigned to him. Accordingly, the Crown withdrew the charges. Taber is located 50 kilometers east of Lethbridge.
