In actuality, she became the Premier and was sworn in shortly after the leadership race. The by-election was irrelevant in terms of becoming Premier.

2 elections ago 10% of Alberta voted for the Alberta Party and not one person in government was elected to represent them. This caused a completed collapse of the party and forces those voters to seek refuge in other camps (mostly the ANDP).
So no, in a lot of way our elections aren't fair and reflective of the populace.

Your argument is one that isn't valid. The UCP won the last election unfortunately and based upon the Westminster system which we have used since the foundation of the government here it is fair to say that the UCP with Smith as their leader were given a mandate by the province (however slim it was). Do I like the fact that a leader can be parachuted in, not really. But I am aware enough to know it happens with such frequency that it isn't of a concern to me.

Our democracy is not very good. It's just a lot better than most other options. But there are certainly better options out there. But it's difficult to implement improvements.
I don't think it's silly to point out the weakness of her mandate. Even within FPTP she only won 56.3% of the seats. That is actually the lowest of any governing party in the history of the province. The next lowest was 58.6% in 1917
The NDP had 62.1% (there are a few other elections that were lower than this, too)
