I believe murder in the first degree is a charge that can be laid if the murder happened over the course of carrying out certain crimes. Kidnapping being one of them (sexual assault, hostage taking, forcible confinement are some of the others).

i guess this was not well planned? How did he think he would get away with it..a dead body and a missing girl. He didn't even leave the county!

The mother submitted to a media interview and was peppered with questions. I'd say she's telling the truth, she seems genuine.
She said she hadn't had contact with the suspect for a very long time. Says she has no idea why he would do anything to Hailey or Terry.

Given such a horrific loss, I hope she is truthful. The skeptic in me is having a hard time, though. If she hadn't seen him in 3 years as one report had it, that was before Hailey was even born. That makes no sense.

Poor lady, loses her kid horrifically, and now half the population thinks she was in on it. I honestly cannot fathom a reason why she would be involved in this way, but that doesn't stop the rampant speculation machine.

Seriously? You legitimately can't fathom a reason?
It's not like people are just inventing reason for speculation. Parents are involved in this type of thing quite often. It's the reason the police investigate them.

And if they have talked since then, I am sure there will be emails, social media interaction, phone and or text message logs. It's is almost impossible to hide anything these days, unless everything is done face to face. That almost never happens though.
This happened in a small town where everyone probably knows everyone or is connected to some degree. Just because the mother knew the murderer, it could mean nothing.

The implication would be that the mother knew of or encouraged the abduction, not the killing. That, unfortunately, isn't unfathomable.

It happens, it's not some crazy out-of-nowhere idea. It's not fair to apply any assumption about what may have happened, but people are going to speculate. She certainly wouldn't be the first person to kill, or have a hand in killing, their own child.
My own pure speculation is that it sounds like the guy went to the house to get the kid, maybe because the Dad wouldn't deliver her to the mom for whatever reason. When the guy was attacked by the dad, he ended up stabbing him. And when taking the child he smothered her or something when she was struggling. That's what it sounds like to me. I could buy that he didn't go there with the intention of killing anyone, and ended up killing both of them, panicked and burned her body. Her possibly sending the guy there to get her daughter doesn't imply that she sent him there to kill either of them.
It's appalling any way you slice it really.

Abduction by a non-custodial parents accounts for 99 per cent of child abductions. Of course the mother has to be a suspect, though I doubt for murder.
Angry mom tells boyfriend she can't go to Edmonton without her kid.
Idiot boyfriend volunteers to go to ex-husband's house to get kid. Gets in tussle with father and kills him.
Idiot boyfriend, now in a wild panic from killing father, tries to carry girl away and she freaks out and fights back. Panicked idiot kills girl.
