Default Apple: The New Microsoft

There's no delicate way to put this: at least part of Apple's patent lawsuit against HTC appears to be a proxy fight for a larger issue with Android as a whole. Apple's complaint with the International Trade Commission makes an explicit distinction between HTC's Android devices and its WinMo phones (referred only to as "DSP Products"), and the Android sets are repeatedly called out for infringing certain patents.
Apple is patent trolling HTC android devices for 20 patent infringements with some patents running back to 15 years ago. Speculation is that it is trying to derail the broader Nexus One launch. Eitherway, this just reeks of animosity.

Here's a breakdown of the individual patents:

http://www.engadget.com/2010/03/02/a...ent-breakdown/

Apparently Apple has patented the use of a finger gesture to unlock an electronic device. Wow.

Ya, it continues to amaze me that Apple skates by as 'The Good One'.

Having read the 'Reasons to be scared of Apple' thread/link last week, all of my suspicions and concerns are validated. I've come to the conclusion that the only significant difference between Apple and Microsoft is.......Apple has a marketing department.

Alot of those patents will have prior art that a company just needs to show and the patent will be void.

This is the problem with Apples strategy of do something better instead of first - you cant really patent something just because you have done it better if the way you have done it better isnt a new concept.

The longer I have an iPhone, the longer I want to get something else as my next phone... I can't help but think that they are going to lose the phone battle in the long run.

Go on. I'm curious to hear why. It might be that I'm used to it, but I'm not as in love with my iPhone as I was a year ago.

Hey if they're going to give you patents, you might as well try and enforce them.

Seriously, moving a GUI object with a non constant velocity? I thought patents were supposed to be about how something is done... i.e. you can patent a method to do something, but not the actual doing of that something.

So they can patent how they move the GUI object (using some specific math in combination with their GUI architecture or something), but not just moving a GUI object that changes in speed as it moves.

Because its not open like the Android platform is?

Because they're being morons about app approval?

Because they want to make jailbreaking a crime?

Great product and all, but I wouldn't even consider getting an iPhone simply because of the fact that they regulate and prohibit stuff like a bunch of Nazis.

Google should just buy Palm right now at pennies on the dollar for all their patents.

Getting into a protracted patent suit is just so anti innovation and a clear offensive strategy to try and hold onto their market share. I think Apple sees the writing on the wall with Android that it will be the next 'Windows' of the phone OS'. All of the IBM clones will choose to adopt Android squeezing Apple's market share to their traditional levels. They'll also squeeze margins as Android is free to use.

However Apple had to think that they couldn't ride the iPhone gravy train for much longer. The market will catch up. Unless of course Apple can corner the touchscreen features through enforcing their patents. God I hope not.

Didn't they do something like this previously, as well? I forget who it was against though.

If google took over Palm, I can just imagine the incredible phones they could produce. I love my Pre.

The iPhone cannot have multiple apps open at the same time, and that is a major sticking point for me. The iPhone still has an edge due to the amount of apps available for it, google would probably help palm cut into that edge.

While all of these are reasons that appeal to me, someone technically inclined, I have to wonder if the population in general cares about any of it.

A lot of people I know when it comes to phones think "oooh shiny!" rather than considering its technical capabilities, especially as it relates to potential future use.

The iPhone still has that cool factor that is going to appeal to most people. I think for something like the Android to unseat the iPhone from its throne its going to have to take advantage of the Apple Nazis and put out some really cool apps that can't (or won't) exist on the iPhone, and get some marketing behind it.

Performance of my iPhone has become terrible over the past year.

In the US, the fact that the iPhone is only on AT&T is helping its eventual demise. If they jump ship and sell on Verizon it will bring in millions of new customers and extend the iPhone's dominance for a while longer.

That said, my android phone can do anything an iPhone can, plus more, and it has double the screen resolution.

It could happen. Palm didn't post any impressive revenue numbers last go around so they might be willing to look at someone like Google.

Competition is great for the consumer, but apparently Apple wants to act like a whiny little bitch than come out with a fabulous product that Android, Google and HTC couldn't better.

I love my iTouch, but if Apple keeps this up I'd buy a Zune before I bought another iTouch.
