Here's a good discussion on Privacy/copyright that I thought I'd share. Teksavvy is currently in a battle for its customers privacy.

Maybe not the right thread, but if a channel that I subscribe to with Shaw, plays a movie or TV series that I want to see, what is wrong with me downloading it later? Am I legally entitled to download it or should I be SOL for not PVRing it? Or are these guys only going after people pirating stuff that's currently in theatres?

I may be wrong, but I don't think there's anything in Canadian law that says you can't download a movie or song. However, I do believe you can't distribute it in any way. If you're torrenting it, you're seeding, and so they can count that as "distribution".

I may be way off there, though, so don't take it as legal advice.

As I understand it, the only reason it could be considered legal to download anything in Canada is that there has been zero precedent that has established otherwise. The media industry is working on establishing that precedent right now, and I think there is a good chance they will get it.

Maybe not illegal in Canada yet, but how does that work in the US? If somebody downloads a tv show from the US in Canada, do they stand to get arrested the next time they cross the border?

If there was no copyright holder in Canada, then I am not sure. My guess is that the entity that held the copyright could proceed with legal action in either their jurisdiction or ours, assuming the violation existed in both locations. I don't know exactly how that would pan out, but I assume charges would eventually stick here. The reasoning, I think, would be similar to people who get arrested after returning from places in SE Asia and are charged with sex crimes against minors committed while they were out of the country.

I assume all content produced in the US has a valid copyright in Canada, since as I understand it, to hold copyright in Canada you simply need to have created the content.
