If the payout was made public, yes it would set a precedent. However things like this are done with the person signing a document stating they are to keep the terms of the agreement private or be sued for the amont paid out.

I've had a lot of jobs for all sizes of businesses and there is on way any employer would ever have given an employee a half a million dollars, because they hurt themselves outside of work.

Not only that, there is not as much publicity to this as there is in donating to charity. Plus in general charities should be putting the money to better use. What would be better, giving one person 500k or giving 500k to an organization that can help a lot of people.

My guess is this case will ultimately be resolved through the court system. If the initial payout was not enough she can have a change in the court order to increase the amount. It is a standard thing and happens all the time. If her costs and suffering are genuine and the party has already been found liable, it should not be a problem. The courts obviously prefer finality but also are aware of the fact it is not always easy to predict costs ahead of time.

Really?

So if Wal-mart refused to sue the woman, then they would legally have to give 500k too all their employees who get hurt? Is that an actual fact?

But it's not Walmart that's suing the woman, its the company that provides Walmart's Health Plan. Walmart doesn't control what they do, as they are a separate company like other benefit companies (ie. Manulife). Both the original payout and now the suing of the woman doesn't even go through Walmart's book. Its between the Health Benefit company and the woman.

I don't know what kind of health plans you guys have, but I have trouble getting them to cover 80% of my penicilin prescription. I wonder what they will say if I get into an accident and and ask them for half a mil?
